Terms of Service

You must be at least 18 years of age and capable of forming a legally binding contract under United States law to use the Service. By registering an account, you represent and warrant that all information you provide is accurate, current, and complete, and that you will maintain the accuracy of such information.

You are responsible for safeguarding your password, for all activity that occurs under your account, and for any consequences of sharing your credentials. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Hurry Terry is a corporate team catering platform that allows customers to place a single order spanning dishes from multiple participating restaurants. After an order is submitted, an authorized administrator coordinates with each restaurant to confirm availability, arranges delivery, and provides the customer with a payment link to be paid out-of-band. We do not process payments in-app and do not store payment card information.

The Service is currently offered in the greater Boston, Massachusetts area. Service availability, delivery windows, and participating restaurants are subject to change without notice.

When you place an order, you offer to purchase the listed items at the prices stated at the time of submission. Orders are not binding on Samyin until an administrator confirms availability with the relevant restaurants. We reserve the right to modify, decline, or cancel any order, including where items become unavailable, prices have changed, or fraud is suspected.

Total amounts may include the food subtotal, applicable Massachusetts meals tax, a delivery fee calculated as a percentage of the food subtotal, and a tip you select. Delivery fees and tax rates are configured by the administrator and may change. After confirmation, the administrator will send you a payment link from a third-party payment provider; you agree that payment is your sole responsibility and is governed by the terms of that provider.

You acknowledge that all prices are quoted in U.S. dollars and that the price displayed at checkout may be revised if items are modified during the administrative confirmation. Any revisions will be visible on your order page before payment is required.

You may schedule deliveries between 24 hours and 30 days in advance, in 30-minute time slots, within the operating window of 11:00 AM to 8:00 PM local time. Delivery times are estimates; we are not liable for delays caused by traffic, weather, restaurant operations, or other circumstances outside our reasonable control.

You are responsible for providing an accurate delivery address and a working contact phone number, and for being available to receive the order at the scheduled time. If we are unable to complete delivery due to incorrect address information or your unavailability, the order may be cancelled without refund.

You may request to cancel your order while it is in the "Pending review" state by using the cancellation control on the order page; the request must be approved by an administrator. Once an order has been confirmed with the participating restaurants, only the administrator may cancel it, and any restaurant cancellation fees may be passed through to you.

The administrator may modify quantities or remove items where a restaurant cannot fulfill the requested portion; in such cases the order total will be recalculated and reflected on your order page.

You agree not to:

• Use the Service for any unlawful purpose or in any way that violates these Terms or any applicable law or regulation;
• Submit false, misleading, or fraudulent information, including in connection with orders, addresses, or payment;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, our servers, or any related systems;
• Reverse engineer, decompile, or attempt to extract source code from the Service, except where expressly permitted by law;
• Harass, threaten, or otherwise harm any restaurant partner, delivery personnel, or Samyin employee;
• Use any automated means to access the Service or to scrape, harvest, or copy any content from the Service.

The Service, including all software, text, graphics, logos, and other content, is owned by Samyin Inc. or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial use.

The "Hurry Terry" name and any associated marks, names, and logos are trademarks of Samyin Inc. You may not use these without our prior written consent.

You may submit limited content to the Service, including order notes, delivery instructions, and uploaded photos for your profile. You retain ownership of any content you submit, but you grant Samyin a worldwide, royalty-free, sublicensable, non-exclusive license to use, host, store, reproduce, modify, and display such content solely for the purpose of operating and improving the Service.

You are solely responsible for the content you submit. You represent and warrant that you have all necessary rights to submit such content and that it does not violate any third party's rights or any applicable law.

Restaurants featured on the Service are independent third parties. Samyin does not prepare any food and is not responsible for the quality, safety, ingredients, allergens, or preparation of any item. You assume all risks associated with food allergies and dietary restrictions and are responsible for reading any allergen or ingredient information provided by the restaurant.

Payment links may direct you to third-party providers (such as Stripe, Venmo, Zelle, or similar services) whose services are governed by their own terms and privacy policies. We are not responsible for the acts or omissions of any such provider.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAMYIN DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any items obtained through the Service will meet your expectations.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SAMYIN, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Samyin Inc., its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your use of the Service, (ii) your violation of these Terms, (iii) your violation of any rights of a third party, or (iv) any content you submit to the Service.

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease, and any provisions of these Terms that by their nature should survive termination will survive.

These Terms are governed by the laws of the Commonwealth of Massachusetts and the United States of America, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to personal jurisdiction in those courts.

We may modify these Terms at any time by posting the revised version on the Service. Material changes will be communicated by email or by a notice on the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
